You can see what titles your friends are playing and they show up as currently playing on the 3ds friends list. My question is, Can Nintendo see this? Can they ban my console because of this?
They can likely see it, and they could ban for it, but none have occurred yet.
Turn WiFi off I guess. Maybe if you use SDK/DevMenu they think you have a Dev unit /s.So They could see that I have fbi open?

essentially what they see is the private header (hence why some flashcarts got banned) other systems cant see it itll show up as Unable to get software title. as it tries to look for the corresponding smdh but cant find it. but nintendo can definitly see that private header.So They could see that I have fbi open?

they can and likely will seing as they banned those who played online with an invalid private header and those people have had there 3ds's banned.Welp, Hope they don't ban me...
however this generally only occurs if playing online with a 3ds game that as an invalid private headerYeah but I like to use the qr code install. Oh well looks like I'll just have to deal with it
and also im sure nintendo totally has cached list of homebrew titles.The way it works is nintendo sees a title id that you're playing and sends it to friends. If. The title id isnt on the server, which a few legit apps arent, they dont see the name or icon.
Im not even entirely sure if nintendo can view the title you're playing. It probably just passes through the server and sends the title id to other friend's 3ds', where those 3ds's download the icon of the title id from the server. Ik that's why adding a friend locally shows homebrew apps as favorites while online doesn't.and also im sure nintendo totally has cached list of homebrew titles.

You should take a look at my current favourite title then!Your friends can't see Fbi installed cias or fbi. I've tried it several times with 2 3ds and when I try to see my favorite it will go the the previous application that was favorited:
example: my favorite title is Pokemon sun, I switch it to fbi. If a friend checks to see what your favorite title is it will revert back to Pokemon sun but on your 3ds it will stay as fbi.You should take a look at my current favourite title then!
