Yea but why would he get in trouble for it. He wasn't even the one that provided the keys.

I made a comment on Reddit outlining why Nintendo are completely in their right to file this DMCA takedown. It seems not a lot of people know what changes DMCA actually made to certain laws and whatnot. They introduced Section 1201, which states the following:

Section 1201 divides technological measures into two categories: measures that prevent unauthorized access to a copyrighted work and measures that prevent unauthorized copying of a copyrighted work. Making or selling devices or services that 2 are used to circumvent either category of technological measure is prohibited in certain circumstances, described below.

...

Section 1201 proscribes devices or services that fall within any one of the following three categories:
  • they are primarily designed or produced to circumvent;
  • they have only limited commercially significant purpose or use other than to circumvent; or
  • they are marketed for use in circumventing.

There's no doubt freeShop violates this.

First, it did use the eShop logo as a base. Second, once they used that to takedown the project, given the very nature of this utility.... It is virtually impossible to put it back up, seeing as it serves only piracy purposes. Hell, its very name states it.
It's hard to defend such a project that has already been taken down.

Fully expecting to receive one of these for CIAngel in the near future, but whatevs, it's all good, it's been downloaded 85,000 times, and Nintendo can't take those copies back :)

If anyone wants to know whether I'm going to counter it, I'm not yet sure. That could permit them to file lawsuit against me and I'm already legally battling more serious charges unrelated to freeShop that left me relatively poor. I'm not going to ask for donations to battle it either since I will likely not get enough and it's probably not worth it.

Cache updates will still work for now. But I'm looking into alternative source/build hosting solutions.

They cite no legitimate violation, from my understanding, except the use of Nintendo's logo on the CIA build (unrelated to the source repos, and they took them all down). That was a mere oversight and I have no problem changing that logo, it requires changing a single line in the source.

To claim it circumvents any protections is laughable, though I'm unsure if it's legally sound (law is often laughable itself). It only circumvents protections if people utilize title keys they did not purchase or obtain legally. If people illegally obtain the password/PINs of a person's bank account, you can't criticize the banking website for facilitating theft. And the argument can be used against their own eShop application, which facilitates theft by installing unowned copies of Nintendo's games when users merely install tickets locally. The only difference is freeShop gives slightly more control over ticket installation, you can even install tickets with nonsense keys you give it and they'll just fail.

You say unauthorized but FreeShop doesn't need authorization to fetch the games from Nintendo's servers. As a matter of fact, no program does. The only part that might be "unauthorized" is what the 3DS itself does.

To be clear -- I didn't say unauthorized. Those are direct quotes from the DMCA document. I'm also not a lawyer so I can't exactly comment further on what the law defines "unauthorized" as.

It's been know to be broken and causing issues with freeShop for a month or two at least. People talk about it on Luma3DS thread all the time too.

Yea ig i mean they do have a right to their stuff, but that still doesn't mean that freeshop is at fault.
If u install freeshop you obviously can see that it's blank and has absolutely 0 games to download.
The only way to have games is to install the keys which is from another person's website that is not provided by @TheCruel.
