No, it is not, we still do not know if the 0102 ban will be 15 days or perma, they can give you a worst ban based on other things on the 3DS.

U can wait the 15 days and see whats happens or install the public LFCS but at least backup your original, the one that was banned maybe after the 15 days U can inject it back and be free to play online with it, if not, well, buy a cheap 2ds to grab a new LFCS or a NEW 3DS to play online with it and the old banned one for solo or local wireless game plays.

Let me tell you about some information that you obviously didn't know, or somehow forgot, or somehow "didn't use".
1. A lot of people got banned, including pirates and legit people that got game cart early.
2. A lot of people also contacted Nintendo. And guess what ? Nintendo could tell exactly who were pirates and who were not, then refused to unban the pirates even if they could prove a legit cart. Therefore Nintendo had a way to tell pirates from legit players.
3. There are people here that got banned after the release date. They did not use any online feature before release. Guess what CIA file they were using ?

ehh no I used it and didnt get an eShop ban.

I can also still create a NNID so your reasoning is wrong.
Only thing blocked for me is online play.

I was one of the people that tested the theory of using the leaked CIA after the release date without never connecting online prior. My 3ds still works with all the online functions.

YOU CANNOT HAVE A DIGITAL GAME INSTALLED BEFORE THE 18TH BECAUSE IT WASN'T LEGALLY AVAILABLE, THEREFOR NINTENDO KNOWS BY LOGICAL DEFAULT THAT ITS A LEAK.
