It has a public.sav (still lying on my pc), but as stated earlier you need signature patches to get a pirated dsiware past system transfer.It's an hackable DSiWare game so why the game don't have a "public.sav" ?
Sudokuhax was originally released for the dsi before the 3ds was even launched. It was pulled and patched before the 3ds was launched as well.But if nooby89 downloaded it off the server directly, it means that the game wasn't really patched (assuming there is only one version still on the server).

You can only ever download the patched version from the 3ds eshop.
