It's an hackable DSiWare game so why the game don't have a "public.sav" ?
 
But I have Sudokuax on my 3DS (cia download) and the homebrew menu actually work (yeah I know it's outated).

It has a public.sav (still lying on my pc), but as stated earlier you need signature patches to get a pirated dsiware past system transfer.
The public.sav loads a boot.nds (which must be a homebrew application) from the SD card,
so it's pretty much useless on a 3DS, since there are already many other ways to load these.

But if nooby89 downloaded it off the server directly, it means that the game wasn't really patched (assuming there is only one version still on the server).
Sudokuhax was originally released for the dsi before the 3ds was even launched. It was pulled and patched before the 3ds was launched as well.
You can only ever download the patched version from the 3ds eshop.

I was mistaken, I thought they downloaded it from freeShop. They said Sudokuhax worked (meaning the unpatched version was still on the server, and if there was only one version of Sudoku on there, that means that it would be unpatched somehow)

But I snipped as soon as I saw ".cia install"
