Im thinking about to buy a 3ds. If I buy the product below, how can I play rom games? Should I buy flashcard or something? Or should a buy non-new one?

If you buy a non-new one you will be good to go for CFW out of the box as they all come with hackable firmware. If you buy a new3DS now, unless you check the serial number beforehand ( according to this thread: http://gbatemp.net/threads/n3ds-xl-firmware-by-version-number.381479/ ) it will most likely be on a too new firmware to use CFW, and Sky3DS which is the only option on newer firmware is expensive and not a very good solution.

Then I should contact the seller and learn the serial of n3ds xl?
From my experience, 95% of the sellers won't tell you the serial because they already know it is not exploitable. And by giving away that info, most likely it won't sell. You can actually tell by the price, 99% of the time if the price is around $200 for a N3DS, then it is not exploitable otherwise people like me would have beat you to it. The exploitable ones will say something like "CFW", "Gateway", "9.0-9.2" in title and the price is close to $300. Save time or save money, it is up to you.

Recently, the price of the 3DS systems have gone down quite a lot in England (£85 or so for the Stock 3DS) - I am wondering whether or not these are repackaged and have firmware later than 9.2? They come in Ice White and Coral Pink

I already have two 3DS systems (New 3DS and Old 3DS - unfortunately both past 9.5 firmware) -

Link to the devices that are questioned here

I already have a Sky3DS card but would very much so like to have the advantages of the custom firmware such as cheats, downloaded backups in the device with easy selection etc. Ebay is out of the question price-wise as these seem to be going for £80-£90 and in horrible condition.. Would it be too much of a gamble to assume that I can purchase any old 3DS and it is guaranteed to be 9,2 or below?

If an old 3DS, old 3DS XL or 2DS is sealed, it is guaranteed to come with hackable firmware.
Ok. I was worried that perhaps Nintendo may have decided to repackage these cheaper models with higher firmware. For example, the new3ds that I had purchased had 9.5 installed (as it was an updated small package without the charger). The previous new3ds systems with the charger were 9.0 iirc.

Hence perhaps the same may apply to the old3ds systems?

Consoles come with the firmware that was the latest one when they came out of the factory. Ones produced more recently have higher firmware, that's why some new 3ds are 9.0 while others are 9.5. Old 3DS are no longer being produced though, the highest firmware that is physically possible is 8.1 (e.g. on the Smash 3DS XLs). Most will have 7.2 or less.

Ok that's good to hear. As long as Nintendo have decided not to somewhat place their test/returned batches in a new-box (or limited final production run) then all should hopefully be ok. Considering ordering a new 3DS, but would be absolutely useless If it has anymore than 9.2 (I already have 2 3ds systems)
