I've noticed that some people are uploading official eShop themes to 3DSThemes.com. What are your thoughts on this?

Help them and report those themes, no one want to see a DMCA claim from Nintendo to 3dsthemes.com

In my book its a grey area since Nintendo owns all of these themes even if they are transformative/creative works I don't report them. If nintendo wants them taken down they can use the contact email for 3dsthemes.

We do not allow this under any circumstances, but its pretty hard for us to catch them with a team of literally four people actively working on the site. Its heavily encouraged that you use our report button when you spot them, and we will immediately get to work on removing the content, and banning repeat offenders.

60$?! jeez which provider is hosting 3dsthemes.com? that's way too expensive imho

Also, the download counter doesn't affect your bandwith, since even if you do multiple click you'll be prompted to download the file just once.
Speaking of which, you should fix it asap, because with an extremely simple console script on firefox/chrome you could farm infinite downloads

It shouldn't be too complex, crypting the download id for the file and making it valid for just 1 download so that the user cannot view it is the way
(Making the id valid for just 1 download would work too, but by editing that script you could farm downloads anyway)

We were hosted by soyoustart.com but we just moved to a different host, and and are transferring our site as I type. As for the download spamming, don't worry, we have something in the works.

This is likely because we are switching servers right now to our final destination. As for the theme, its alright, everyone makes mistakes, we will remove it when our site is operating on its new box completely again. Thanks for letting us know.

I still don't get the sudden shift of not allowing themes from the eShop is it because they need to be paid for? All the themes on the site right now Nintendo could taken down so what makes the difference between a paid/free/made theme?

That is the reason. First of all, we don't want to be a piracy site, and obviously hosting themes that are being sold, for free, is piracy. While we don't care if you pirate, we don't want to make our site the go to place to pirate. Since user created themes aren't actually being sold, its essentially a little bit safer for us to do what we do, since nintendo isn't actually losing out on sales of themes they have.

I figured as much I uploaded Onemuri Pikachu when the site first popped up but changed the Music used in the theme so I guess transformative works are ok? I have a lot of themes that people can no longer get that I can "tweak" I guess ill do that then though it is a little time consuming

Yea thats alright, sorry for the inconvenience, we just don't want to be DMCA attacked to the ground. :/ I personally couldn't care less whats uploaded, but for the safety of the site I have to enforce this.

Hi, I just finished my first Theme and i really put a lot of work into it.... costume folder, borders, made in photosshop, matching colors, all based on hyrule warriors menu aesthetic and fairy fountain , even made a music loop of fairy fountain... but i can't get a good bcstm file... when i use the converters it always ends with a loud wind like sound on the beginning an remains silent.... if someone can pleas convert it and send it back to me i have the wav with loop here..... thank u
