Nintendo has decided to move to the next step: It has officially sent me a take-down notice under DMCA. This means that Nintendo can no longer claim that this is something Youtube is doing on it's own. In order to file a DMCA take down notice a company must be willing to be dealt with in Federal Court, so at this point the Mandatory Arbitrary agreement is null and void. I submitted a counter notification, so Nintendo would have to give notice of it's intent to bring me to Federal Court within 10 days. If they do there are very clear penalties for abusing DMCA. Even if they don't I know have the right to take them to court. In either case, Nintendo would have to show how the use of the software that I paid a license for constitutes copyright infringement.

Out of curiosity, could you make a new thread and post updates there? I'm very interested in how this turns out, because it might actually start changes in Nintendo for the better, copyright claim-wise, but it only loosely applies to MarioKart 8

Seems as though DLC 2 will be out soon enough (May 2015).

Last year, Mario Kart 8 received a huge DLC update that added new tracks, characters and vehicles. It was a well-known fact that another DLC pack would be making its way to Wii U owners, but we weren’t exactly sure when. Now it’s been revealed that the development of said DLC pack is nearly complete!
An announcement was made on the Japanese version of Miiverse confirming that the pack’s development was nearly finished. Now with an estimated release of May 2015, the newest DLC pack will be Animal Crossing themed, complete with four brand-spanking new characters and 8 tracks.

It's been a dry year so far for Wii U gamers (unless you've played Kirby, Mario Party 10, Mario Vs. Donkey Kong or whatever budget title) so it's great to finally have the second piece of DLC out for Mario Kart 8.

Japan's gonna have Xenoblade X out next month but EU/US? Still nothing.

Having video copyright claimed on youtube doesn't mean it's not available. It just means Nintendo will be getting all money from ads. Maybe that's the main reason why they put that into the game in the first place?

My "xXx Hot Yoshi 360 jumping green shell no-scope action xXx" is relatively popular, as I don't have ads in any of my videos, just accepting that it's copyright claim keeps the video up. For every 10-year-old playing the game that's more than enough that they can share their awesome gameplay on miiverse. However I do hope that there would be some clarification to lets play or gameplay footage overall so that we won't get another nintendo situation for those who are actually trying to make content for others to watch.

When a DMCA take down notice is filed the video is no longer available, my youtube account gets a copyright strike, and I loose access to youtube features.

• New Racing Mii suits (Mega Man, Pac-Man, Sonic, Toad, Wario, Villager, Rosalina, Bowser & Olimar)
• 200cc Mode
• DLC Pack 2 with 8 courses and 4 characters (Villager male/female, Isabelle, Dry Bowser)

I think this is it. Nothing about the Battle Mode though, which is a shame.

I'm really pumped to play 200cc more so than the DLC Pack 2.

No kidding! This will add some actual difficulty to the game, and will definitely extend the lifespan of it. Nintendo is actually making decent decisions!!
