It says on 3dbrew that vulnerabilities in something used by xcution were patched.. does that mean 3ds isn't hacked anymore?

I think similarly as you did. But neimod seems to be missing for a long time (>= 2 months), left yellow doing the job.Neimod was trolling when he said they'd never release the hack.
Also, if I remember what I read correctly, certain vulnerabilities were patched in the recent update. However, yellows8 said that the exploits fixed were never intended for public consumption anyway; they would never have made it into a released hack. He also said there were other known vulnerabilities that they hadn't confirmed as unpatched at the time. Admittedly, I've been busy since then and I'm not sure on the status since then.

Trolling is more like he deliberately said that even though it's not true, in order to annoy people. Trolling can be other things, but always with the intent to annoy/confuse people. That's kind of why they call it trollingI never really understand what people mean when they say "trolling". does this mean he was just lying to get people to stop asking him, and he'll eventually release it? and if so, what's the basis for that conclusion, did he tell you in private? (I'm not saying I don't believe you btw, just that I don't really understand.)
it seems to be pretty straightforward to me, he doesn't want to release the hack because it can be used to pirate games and when that happens, Nintendo will probably start cracking down on the homebrew scene. at the same time I'm not sure if there's any way to hack the system in a way that allows regular homebrew and foreign games, while simultaneously disallowing pirated games. that doesn't seem very likely to me.
there are probably a fair amount of exploits in the system, some of them useful and some of them not useful. when Nintendo patches things, they could be patching some exploit nobody had found yet (even the hackers who keep their exploits to themselves).
Neimod and Yellows8 said they would not release the current hack because it's kernel-mode and they don't want random people writing code in kernel-mode because it would easily allow ROM loaders. We were told this as far back as December, so I'm in with the "Who cares?" crowd since nobody ever said they were releasing things, and the people who were working on something did say they weren't going to release it. it should not be too difficult to release the hack anonymously. nobody knows what the hack is, so if a hack is released, there's no way to implicate anyone specific. so I'm guessing it's like he says, he doesn't want to release it because of the potential for piracy. which is a fair concern, Nintendo would probably crack down on the homebrew scene if that were to happen.I can understand him being afraid of a lawsuit, but that's why you don't let people know who you are
Such a lawsuit would bankrupt anyone, if I was him I would probably be afraid of it as well.
I don't think anyone knows whether he was serious about not releasing it but he has seemed to be against releasing anything since the beginning and that may not change any time soon.

People like this are keeping the homebrew scene back. If someone codes a warez loader or WAD manager, it's them who are responsible for enabling piracy, not the people who release the homebrew-enabling hack. The hack is just a way to run homebrew, what people use that capability for is their own responsibility. I just don't get that kind of mentality.
Team Twiizers tried this with the Wii, hoping that Nintendo would be less focused on blocking homebrew if you couldn't pirate with it. And for a while, you couldn't.I agree with you on that point. It could be argued that making a hack with no possibility to pirate would make companies less inclined to bash at homebrew makers,
but seeing how things are, I don't believe in it at all.
