Sony did that with the PS3, and Nintendo sort of did that with the DSi. Pre-DSi games aren't signed like games made after the DSi came out, so for those older DS games, the DSi uses a whitelist to tell if they should run or not.They can do that... ?
That's why flash carts present the icon and game info of a real game, to bypass the game check.
