I downloaded the emulator and it seems legit after looking at some of the files encluded.....it seems a bit much to be a troll, but the "bios file" is needed to play and the download link for it is protected by a survey.

Nah dude. The 3DS hasnt been hacked, so we have no way of building an emulator. Delete it, you might have viruses now.

Welcome to the temp, read the rules and stickies. please.

Does a 3DS emulator that includes playstation bios and plugins and supposedly may have previously been an xbox emulator or something to that extent sounds like it is legit?

tl;dr
Maybe take a look at what you are downloading before trying to get the illegal bits.

Do you need to do a survey or install a toolbar to get the initial download, or does the initial download lead you to a survey site to get all the files or the password for the download?
If the answer to these questions is yes, then it's fake. There's other signs to watch out for (comments disabled or held for uploader approval), but the survey download is often enough to know it's a scam.

No and I will explain why...
1. the plugins are pcsx2 optimized and it is in their header
2. the internal blocks countage leaves you with 750MB~ of memory on the 3ds, yet the hardware points out for 1GB NAND
(http://www.3dbrew.org/wiki/Hardware)
meaning bios+OS=256MB, the BIOS file alone can't be over 1GB like the one the website hosts, header of that BIOS is actually pointing out to be Wii BIOS, to see that you need to use an hex editor and view the first addresses of the plugins and the BIOS file

edit: Rydian, Jurassicplayer, don't bash on him, it's happened that the forum plain leecher found out new news, posted about it a question and made a discovery for the entire forum, AKAIO developed from Acekard R.P.G being open-source, if Normmatt wouldn't know that acekard 2.1 (being closed source) developers were willing to share it's sources for AKAIO, AKAIO would've been limited to R.P.G only
