I'm sure this has been posted one million times! But I'm just curious, has Nintendo even dared to keep there word?

If it's been posted a million times, then your answer could have been found by searching for it. Either way, Nintendo won't sabotage their own device on purpose. If you do anything contrary to the designed workings on the 3DS, such as modifying it outside it's intended method, and their own updates render it unplayable due to your actions, then it is not their fault. They laid down the possible problems should you take matters into your own hands, and so the problem will also be in your hands, not theirs. It's your 3DS, so you can do what you want with it, but they are not responsible for the problems that occur should you intentionally mess with it. The internal workings of any device can be pretty delicate, and they can't always clean up the random crap that an unofficial modification does to it.
