Nah, we said we may open-source it after the entire 3DS platform ("New" and all) are completely discontinued. With our code at the state it's at, even if piracy on the 3DS was common it would be very dangerous still.

It would be dangerous because everyone would be able to pirate -> nintendo can't sell games anymore -> no new games/no nintendo ds

BUT, if they discontinue the 3DS, then they don't make profit on it anymore(almost) -> (almost)no damage
