Hacking Will Nintendo ban me if I install cfw?

I have been using CFW for a while now and have yet to be banned, and because the 3ds is no longer getting updates I probably never will.

It really won't matter much longer if you can or can't get banned for installing in a CFW, so why even stress over it? We should be working on a replacement for the online services like we did for the Wii and DS.
