Will My Switch Get Bricked if I Do This?

I transferred this question to Switch Noob Paradise so please answer the question there, I don’t know how to delete this post so this will keep up until I or someone else can delete this post. I want to transfer my Switch data to my Switch 2 BUT I am NOT on my Emummc, instead I am on the original console (Pre hacking). I think I still have some “hacked” files on my sd card and due to the more strict EULA agreement I am scared to update my Switch and then upload the files to their servers. I connect to the internet just fine though, I haven’t gotten banned. I can’t access the Emummc because when I try to load it from Hekate it gives me an error, I looked for the error code online and tried all the solutions but I still couldn’t access the Emummc, mind you I tried this about 6 months ago in December, so I might post another thread asking for help because it has been some time and I would rather use a specifically made Homebrew software to transfer it to the Switch 2. So main question of this thread is if I can update and load my Switch data to Nintendo servers while on original (Pre hacking) console without getting bricked.

If you haven't installed any pirated games or never modded save games for online games, then usually Nintendo doesn't care what is on your SD card.

I have (regrettably) pirated tens of games on my Emummc, I have TRIED to mod SMO but the download would stop while downloading, so I don’t know if that’s a possible violation. In case you haven’t read the addition, please respond to this on Switch Noob Paradise.
