iirc, a9lh can boot into a sig patched sysnand. This would theoretically resolve this (and being that a9lh can theoretically be used to boot up something to restore sysnand in case stuff goes sideways, this is actually somewhat more viable now than it was a while ago).

why does it have to be sysnand though? thats what i dont get.

Im really stupid when it comes to this stuff. so this cant be patched to run dsiware from emunand i guess this is a hardware thing that patches cant fix?
Right. The AGB_FIRM CIAs work by emulating a GBA cartridge in the 3ds; the 3ds then reboots into "DS mode" which detects the GBA cart and boots that. It's for the same reason that DSiWare can't be run from EmuNAND; it reboots into the TWL_FIRM of the 3ds. So far there is no way to make it reboot to EmuNAND. GBA may be impossible, I'm not sure about DSiWare, but I suspect it's the same case.

Yes, for the most part. (It's not really a "hardware thing", but you know).

So either install DSiWare/GBA stuff on both sysNAND or emuNAND, or move to sysNAND so you only have to install them once.
