It isn't necessary for you to risk getting banned. While I would love to be able to have a hacked weapon, I prefer to just wait as there is still too many unknowns about these recent bans.

Where did you see that info? I don't believe that's the case, otherwise the banwave would've been far more devastating.

I'm not banned, and I only have two legit (cart) games next to the ~20 pirated (digital) ones.

I can't imagine it will stop until hackers find a way to stop it themselves, probably by more effectively masking CFW consoles. Nintendo isn't going to ban CFW users one day and suddenly be alright with it the next.
