If you were interested in hacking you shouldn't have kept updating your 3DS. You need to either get a new console/hardmod or use what is available which AFAIK is install Legit CIA's (If you do not have a DSiWare)

You can't use a one year old source to tell what firmware is on, the 3ds is not selling poorly so his 3ds wouldn't be a year old out of the factory. He has no reason to lie anyway.
