    It's still an unproven theory.

It's more that if the Nintendo Network Administrators notice that the console is running a custom app, they will see it as a console that they think doesn't deserve to use the Friend Service anymore, so they revoke the certificate for that console (which is encrypted in the SEED cipher algorithm). Regardless if the person has purchased from the Nintendo eShop or not.

For more information on SEED block cipher algorithm, click here.

If we can find a way to figure out which domain those administrators are checking to check for bans, it would be helpful in determining which one we can block, possibly through CFW.

Question: Would playing a hacked cia with wifi and spotpass disabled, and after using it wipe the play time history with cthulhu make the cia invisible for nintendo?
Or they have other means of saving the play history while you are offline?

there are countermeasures you can take to reduce risk of being banned (check the first post and do a bit of research), but nothing is a guarantee.

If you want this 100% no ban guarantee, im gonna give you a quote from a movie:

"whats the safest way to go skiing? don't ski."

Will every important change and update still be edited into the first post?

I'm currently waiting for both a flashcard and a n3DS XL.
Once I get both, I'll SysTransfer my original o3DS to there, and install CFW on my o3DS.
I'd still like to keep my o3DS, once it's running CFW, unbanned. So I appreciate all the work you guys do here.

    Hi, I have a doubt:

If I clone my sysnand to emunand, and just use the emunand for VC games (never go online with emunand), would these VC games played in emunand appear in sysnand activity log (sorry, I've never used emunand) or do they have separate activity log?. I'd like to know if these played games would leave any trace for Nintendo when playing online with sysnand.

This is just for avoiding clearing activity log every time with sysnand, I mean, won't be suspicious if any time we go online our history log changes?

    Thanks

It would not make a difference. As stated in the updated OP, your local activity log isn't sent to Nintendo (nor do Spotpass settings make a difference).

Jeez, maybe Nintendo is waking up after the third banwave.
After introducing the 11.6, there's panic through people..

Yeah, if buying the retail games early before their release date, most likely.
even more, they'd going to dump CIAs from their retail games and post these online.

That's what I think. So, please, be carefully of downloading pirated games before the public release.

Aside from blocking some network features ban doesn't really "brick" your console in any way, does it? So I understand that if someone doesn't play online anyway, it is not going to hurt much?
