    It could have previously had cfw though. He could have also transferred the firm file to ctrnand. I don't know why someone would go through that much work though

    Cool, thanks for making it clear, though I just thought of one more thing

    Can game DLC still be purchased? I'm wondering since, while the DLC seems to be purchased using the eshop in some way, you're only able to access it from within the game that the DLC is for (which is unlike the Wii U, where the DLC can be purchased directly on the eshop)
    Mind you, I already have all the Hyrule Warriors Legends DLC, and I have all the SSB4 DLC (except most of the Mii costumes), so the only way being unable to purchase DLC would affect me would be if a new game comes out with DLC I really want, or if I feel the need to go back and purchase all the NSMB2 DLC or the rest of those Mii costumes

    I suppose if DLC purchasing is blocked by this ban, I COULD use.... unfavourable methods to obtain it, though I don't WANT to have to do that.

    I think you can purchase them but use them... not sure. For example, FEE DLCs recquired Internet functions (Im banned and I cant use them xD)

    He played only license game and dont like piracy. And he will not lie to us and ask help from ninsupport. It's pointless. He really got frustrate.

    Some DLC shops somehow don't let you access (like Smash Bros'), but others do. It's kind of variable, probably because of the way each game access its DLC shop

    For those not accessible DLC shops, all you can do is using the Free open source version of the eShop (yes, it still works when banned), but as you say, you may not want to do that.

    I always wonder if there's a monetary aspect to this. How many people who aren't banned but have cfw were still spending money on the eshop?

    Kinda odd the SSB 3DS DLC shop would be blocked considering it seems to be linked somewhat to the Wii U versions DLC shop that is linked with the eshop
    I assume games released prior to the NNID introduction to 3DS would have their DLC shops unavailable?
    I figured that "free open source version of the eshop" would still work. If the real eshop still works when banned, that one would DEFINITELY still work. While I wouldn't WANT to use those methods, I likely will have to if I get online banned. And as for online game play in general, guess I'd have to wait for homebrew people to engineer their own online servers for banned 3DS owners. I'm sure that could be possible, considering it was possible on the Wii...
    This ban seems to be motivated purely by a sudden intense desire by Nintendo to stop all hacking and cheating in online games (which is understandable, though it would have been nice if there was a way for Nintendo to only ban people who HAVE cheated, but it must be just easier in general to ban all CFW users than to find out which ones have cheated in online games). Not banning Miiverse or the eshop seems to support that

    That's a strong possibility. I bet 70% of 3DS's have been modded, if not, at some point.

    the only thing that worries me is that I am playing echoes (usa version in usa system / cartridge) and because I don't want to update to 11.3 I use the region free launcher to play the game, in my activity log the game appears as "??????????"

    no ban, no cfw, only homebrew
