I think a lot of people who say Nintendo won't fix their console also install pirated wiiware and virtual console wads. Installing those wads on vWii is a risk anyway, because they can cause damage. They probably check the serial number or other console identifier and see if those wads were installed legitimately. My vWii has the homebrew channel, and that's it. That's all it will ever be.
