Unjust law?

To being, I find it depressing that this is my first blog entry.

I work in a restaurant/bar. One that frequently hosts parties and other events of that nature. Tonight was the night of one such party. Once my shift was over, I got ready to leave. Now, to set the picture, there's an outside area, with a projector, tables, all that jazz. Tonight, it was also loaded with people, all of which were partially drunk, at least. The parking lot was completely packed as well. I parked where I usually do; the closest non-handicapped space. To the right of my car is a tree, and the the left a huge truck. When I say huge I mean that the wheels alone came halfway up my door. Directly behind me is a handicapped parking space. Being that there were so many vehicles, it was quite difficult to squeeze my way out of the little parking space that was left of my area. I had to pull forward, climb onto the curb in front of me, and cut it really sharp to the right to avoid the car behind me. It took me roughly 4 minutes, but I eventually got out. When I got home, however, my boss called and told me that I backed into an off-duty cop's car. So, I had to go back. I did, and when I got there, I talked to the guy who I ''backed into''. First of all, he was illegally parked in the handicapped spot behind me. Second, I looked at his car. There was absolutely no damage. Nor was there to my vehicle. Regardless, I had to file an accident report, because I reportedly ''damaged his vehicle''. So, of course, my insurance is now going to climb a bit. What are your thoughts on this? From what I remember, I'm fairly certain that I didn't back into anyone. And, without the damage to prove it, is there some way I can get out of this?


tl;dr
Cop, who was illegally parked, claims I damaged his car by backing into it. No evidence to prove so (vehicular damage, video, etc). Wat do?
 
If he has no evidence then it doesn't matter I guess.
I wish I could ask my grandma since she's a lawyer but I bet laws are very different in between where I live and Louisiana.
 
Are police officers actually allowed to park in handicapped spots? I mean, I see them flash their lights and run stoplights frequently, though I'm sure they aren't suppose to do that either.

No, they're not.

If anyone looks into the report, as there is no damage, he'll be scolded at best.

These kinda cops are real pricks.
 
why did you sign a report for something that didn't happen?

I'd have been arrested if I refused to sign. It would have been classified as a hit and run if I didn't sign, because I left the area after the 'accident' took place. My aunt is a cop, and my friends dad is the chief of police (I believe). I'm going to try and speak to them about it, and see what they can do about it.
 
Let them file the report. Your insurance company will look into it also. Without proof of damage to either vehicle, the insurance company on BOTH sides will just shrug it off.

I hope your right. I really won't be looking forward to an increase on my insurance. I've got enough expenses as it is.

What most people believe is, insurance companies will be at eachothers throats trying to pry money from one another. The exact opposite is usually true. The insurance companies work together to get both sides of the story and work out a solution.

Let's say that you tell your insurance company a lie. The other insurance company gathers evidence against your lie, and they share it with your company.

Sounds reasonable. If that's the case, I'm sure that they'll ask for pictures of the damage. In which case, no pictures will surface, and the company will rule in my defense.
 
I could be missing something, but what if the damage is actually there, but you didn't cause it? That would mean the evidence is definitely there. It wouldn't be a bad idea to keep it hidden from you either. Maybe the cop knows your innocent, but just wants his car fixed. By hiding the evidence for you you have no chance to prove it's fake, giving him the opportunity to get his damage repaired.
 
I would've asked to see the damage before signing anything. Also I wouldn't really have been afraid of being arrested if there is no damage since I did nothing wrong, there is no evidence of me doing anything wrong and the cops down at the station would likely just be annoyed somebody wasted their time.
Of course I know barely anything about law but I know that if there's an accident there's got to be at least a scrape.
 
Sadly, what Maikel said is true, but just try to act like nothing happened (shouldn't be hard since you don't know if anything happened or not) and if they DO find any evidence, make sure they take into account the cop was the first at fault. Also, if you can find any kind of pictures to prove that statement (surely there must be some pictures since you were standing on a parking lot full of people) that's even better. If the cop can show no evidence at all that his statement is true, you will win the case and the cop will get scolded. So, go for it!
 
Reminds me of a story about my dad.

So a year or so ago my dad was at a friend's birthday party. He was with a few other friends standing outside his apartment door and my dad had a drink with him (an alcoholic beverage of course). Cops were driving by and then start sounding that warning alarm and pull over to my dad. They charge him with drinking in public or something (not public intoxication but like drinking alcohol in public) and my dad thinks the charges are a little over-the-top since he was literally just outside his friend's apartment and it's not like he was stumbling drunk in the streets. My dad doesn't want to cause any trouble though so he takes the ticket and goes back inside. As he's going inside too, the cops in the car take a huge wad of garbage and chuck it into the streets. That's littering and it's a heftier fine than what my dad got. They then just drove away.

Douchebags. Some cops are just douches.
 
As far as I'm concerned, if you know you didn't hit another car, why would you willingly go back and sign papers saying you did? That was mistake #1.

Mistake #2 is blindly answering the phone after a long day at work.

I'd bet that if you didn't answer the phone and ignored the message, nothing would have come of it, since there's no damage and hence no proof of any accident.

Sounds to me like you just got scammed by the police for ticket money. Don't thing for a second that that kind of crap doesn't happen.
 
A large pickup truck backed up and crashed into my mom's car. It was on camera and everything, but he blamed my Mom. The whole front of the car was busted, and nothing happened to his car, yet, there was still an accident report.
