You seem to think CIAs work that way and SOME do, but there's no way to tell apart games you are playing being a downloaded version or cartridge, unless it's an eshop exclusive, in which case there's the risk you mentioned. So if the CIAs are games that can be found in cartridges, there's absolutely no risk, otherwise people would be getting banned left and right even without CFW just for playing the cartridge version of games.
Yes there is dude. .Cia and cartridges use different headers... Cia installs use your consoles header while cartridges use their own. None of that matters with what I'm talking about. I'm not saying they can see you're playing a .CIA... Please read what I wrote. Unless you bought the game from eSHOP the ticket is not legitimate period (and if it's a HomeBrew/VS Inject) the title ID does not exist on the CDN.

That's the entire reason these titles don't transfer when you use a system transfer to another console. And a factual reason why Nintendo can determine if you paid for your shit or not.

EDIT: I never said anything about using .cias vs cartridge dumps. I have no idea why you even thought I was talking about that. I'm talking about the tickets and the title IDs not matching with official Nintendo releases, which has nothing to do with playing them; just having them installed.

Sorry to trudge in here, but is this entire thread predicated on the assumption that using FreeShop will get you banned? Because that's not even remotely true.

Lol because you haven't read my replies.... I never said freeshop will get you banned. You guys don't like to read thoroughly do you? I said downloading stuff from freeshop does not have legit tickets. How is that so hard to understand? When you buy something from eShop your ticket is legitimately signed and will be recognized as such during a system transfer. Anything you download from freeshop will not. Any VC Injects/Homebrews you have installed do no have legit title IDs when checked via CDN.

I never once said it would get you banned, I said it's ignorant to think Nintendo can't see that everything you download from freeshop is not legit directly because the tickets or title ID are not valid on their server.

That should be common sense. Go ahead, download some games from freeshop, and some homebrew and perform a system transfer. Only the things you actually bought will transfer, everything else either need their tickets reinstalled or the title entirely. You know why that happens? Because the tickets/titles are not legit.

Nobody seems to read the banwave thread's updated OP.

It explains why turning off spotpass makes no difference and other things. And yes, games downloaded via Freeshop do not have legitimate tickets and there are ways Nintendo can figure it out based off of that.

Bans subsided months ago for the most part so you don't need to worry too much.

Not to mention the fact that even entering eShop with certain pirated DLC or custom themes automatically removes them too.... So it's completely obvious that Nintendo's server recognizes legit installs from pirated content.

I'm a little shocked because I thought most of this was common knowledge. Do you guys really think using freeshop makes those games "legit" on the server? Because it never has and never will. It's the equivalent of downloading a .cia through Ciangel or CDN-FX or from a warez site....

Downloading a game anywhere but the eShop will give you an illegitimate ticket.

I'm not worried about bans myself. I use all Homebrew in CIA format, all this fear mongering is ridiculous. I'm just trying to inform people that freeshop isn't this magical app that gives you free games without Nintendo's knowledge. If you're using all your homebrew in .3dsx format, but still using freeshop candidly you're still being completely obvious to the server of your hacks.....

Actually I use Freeshop.3dsx not .cia and I always play pirated game offline and before I turn on the Wifi always play some legit games after .cia games then turn on the Wifi. But you have a point about the games form freeshop. Is this mean I shouldn't play any pirate online game like smash bro or mario kart?
 
Maybe I'm just lucky but I've unbricked my DS with ntrboot whilst being connected to the internet then installed everything, even homebrew launcher CIA and free shop CIA. I've played pirated Smash, Sun online. Even set Freeshop as favourite title.

You aren't lucky. The bans were common during the banwave but stopped almost completely (save for one or two reports) since then.

I would recommend reading the banwave megathread OP as well as my mini Q&A on Reedit.

I know about the ban wave, around that time my little brothers DS got temp banned, Nintendo probably will follow up with another wave, the next might be catastrophic
