There is no consensus, just a lot of conflicting reports.
At the very least, there is agreement that mixed or incomplete dumps will ban you.
MigFlash say public dumps won't ban you but there are reports otherwise.
As for staying offline, it doesn't matter. The logs will be generated and sent the next time you go online, with no way to clear them. If you have dodgy logs on an unhacked Switch, you can consider it already banned.
I see. So even if the game is not present at the time, the logs will be transferred when you connect?

The Switch stores telemetry even when its offline so using Airplane Mode or removing the Wi-Fi settings merely delays the inevitable.
 
Have you ever seen the blue light? This is screaming sd card issue, either hardware or formatting.
No I've never seen the blue light! Also I've tried more than 4 different SD cards 2 of them are SanDisk and I always do format them to system file exFAT I've even tried Linux.
I've seen a guy on a forum who said he had the same issue but when he switched to windows it worked fine for him. I've spent almost 2 full days trying to solve this issue(even tried different switches) and yet I couldn't find a solution.

Are you on a Mac? Does your Disk Utility app say this for the microSD?

This is a noob question but does the switch modchip come with the same ban risk? Can a modchipped switch go online without issue?

There have been no instances of a ban for people solely using the modchip which makes sense because most people wouldn't install a modchip then not do anything with it. However the purpose of a modchip is to use CFW and homebrew which do carry a ban risk. So while there is no ban risk for using a modchipped Switch online, its kind of impractical to only have a modchipped Switch.

Just to add on to what others have mentioned, it isn't the modchip per se that mitigates the risk but the modchip enabling the use of emunand that helps mitigate the risk. The thing that many mig users don't understand is that anything that is done on the switch's sysnand is logged. That's why a separate emunand on a sd card is used in place of it. So that the main storage of the switch is never "tainted" and can be used to go online. When one uses a MIG on an unmodified switch, it's still running on sysnand.
 
It should be mentioned that you are only safe from bans with a modchip if you exclusively run homebrew and pirated content under emunand and offline. As soon as you install something you don't own to sysnand and you go online you are screwed the same way as using the Mig with pirated dumps.

Personal experience:
I have not been banned for using homebrew via the album or game override (hold R launching a game) in sysnand but i only used save managers and other harmless homebrew so far. Cheats or unlocking DLC via save editing can also get you banned.

I have not been banned for using homebrew via the album or game override (hold R launching a game) in sysnand but i only used save managers and other harmless homebrew so far. Cheats or unlocking DLC via save editing can also get you banned.
If I had some spare cash, I would cause absolute chaos in the new Pokemon games. I would have two Switches, one hacked, one legit. I would get tons of shinies, perfect stated Pokemon on my hacked Switch, and local trade it to my non hacked Switch, and dump them on Wonder Trade. I used to do something like that on the 3DS games when I was bored, like trade a level 100 shiny Magikarp via Wonder Trade.

Switch firmware 19.0 out. Anybody got the guts to upgrade and check if the MiG still works?
Atmosphere won’t support 19.0 for a few days so I can’t test until it does

This is basically what I was referring to. Just comparing migswitch (which I’ve already purchased) with a picofly. Does the system store logs that upload to Nintendo servers when you connect to the internet like they do with the mig?
