Hacking The software was closed question

so I quite often get software was closed normally with smash nsp which is fine because I put it to sd card but last night I finally got MARIO kart 8 working by an update I downloaded by unofficial means , the game has been sitting on the switch itself that I downloaded from the e shop before I got banned and still got the error. My question is where do updates sit on the sd card or the switch itself I don’t understand how I can get that error if it’s reading of the switch internal memory unless it’s a sxos problem itself , both sxos and switch have latest firmware

Update went on find I got up to the 3rd race then boom
