I was told that the PAL version of smash stack couldn't come up 'cause, PAL game was patched by BigN for its release.

That's a load of crap (obviously). The exploit was not fixed before Nintendo released PAL version, PAL version was out well before Smash Stack was. (I'm pretty sure I had the game by the time Smash Stack was announced/released, and I waited at least a few months if not a year before getting it).
