Hacking Sky3DS+ and banning question

Do I risk getting banned by Nintendo for using a ROM without a private header on something that merely shares data, such as Happy Home Designer?

Each 3DS roms contains header unique to the cartridge. Nintendo basicly checks if multiple header are online the same time and bans them

CIA's pose the safer alternative as they use your Unique System ID instead much like a cart does with it's Private Header, if there are games you are really paranoid going online with. Choose a large SDCard (a 32GB will handle over about 16 games if you stick to Online only ones going to it) and install them as CIA and leave offline games to your Gateway.

You know what else is equally safe? Patching your own private header into your ROMs.
