Code being pushed to github doesn't mean it's released. It means the devs working on the code made a change to the code that was worth saving. Pushing to github is the equivalent of hitting Ctrl-S in Microsoft Word. Would you consider every time an author saved a document in progress as an official release?

I don't know where eveyone else is getting these from, I got one from a different place.

I'd recommend googling '3ds cia pack' cant miss it, honestly if you can't work out something like that on your own i'd re-consider whether you should be downgrading yet.

You don't need to upgrade. Many people downgraded from 9.9 to 9.2 and it worked
