Hacking Question SD Card on sysnand & emmunand

Hey guys. It might be a dumb question but I was wondering: can I download games from my OFW to my SD Card (this SD Card has my emmunand as well).
Is there a chance of corription or ban? (I think OFW doesnt read beyond Nintendo folder but anyways, I want to know). That way I could have some of my legit & pirate games in one SD Card.

If your SD card is exFAT, then yes there is a chance of corruption. But I don't understand how downloading games would lead to a ban
