Hacking Risk to using the Nintendo Channel?

I know Nintendo can receive data about the channels you are using when you access the Nintendo Channel, so can't they see that I am using the HBC? Is this a problem and if it is, what can I do about it?

Yes, they probably can if it sends that data. However, I doubt that Nintendo will do anything about it. If you are worried about them intentionally bricking your console, that will not happen.

But the problem is that when I start the channel I believe the first thing it does it receive data from me before I have the chance to opt out...

I don't think it matters. I have the HBC and the Nintendo channel and I've been fine. The weird thing was that when voting for how I like which games I play for more than an hour (I've used hbc for more than an hour), I believe it showed the HBC as a Pyjama Sam Game (which wasn't even out at the time XD)
