I had a CFW 3ds with my freeeshop digital games. I need it to send it to repair so i uninstalled cfw and made a backup of my saves with checkpoint. Nintendo replaced my console so I lost my NNID and my games with it. My question is, can I just reload my saves without getting banned?

Restoring saves won´t get you banned. like Joom sayed
You can backup any game that you have saves with
Just be careful with the saves

What the others said, however there is one case where it's best to not restore saves. Never restore saves on a Pokemon game IF it's linked to the PGL, otherwise you are very likely to get an in-game ban. If you haven't linked the game save to the PGL, then you can restore saves freely and worry free!

whats PGL?

Pokemon Global Link (http://3ds.pokemon-gl.com/)

It keeps detailed logs every time you sync with it (basically whenever you go online) and if your save doesn't fit those logs, then you are very prone to getting banned for manipulating save data.
So if i turn the wifi off hack me pokemon with pkhex doing it so they are legit and turn it on can i get banned then?

You are risking bans for restoring backed up saves ONLY if you have the game linked to the PGL. As for using hacked mons, unless they are obvious hacks (eg: Sturdy Shedinja), you don't have to worry about anything. If they pass the PKHeX legitimacy test, then it's all good.

Then how does it handle using multiple sd cards and or formatting the game save? It might be a ridiculous scenario but it's possible.

Every time you start over the game, you need to re-register on the PGL. Also, starting a new game is the only way to de-link the game from the PGL. What you link is not really the game or the game copy but rather just your save.

You have to be online to use pgl I believe,so if you stay offline till release day,you should be fine.

You don't USE PGL, it's just synchronizing whenever you connect online IF you have the game registered on there. Do whatever you want, just don't restore OLD saves over one that is linked to the PGL.

How would it handle me duplicating my sd card to my pc, running the save for a bit, and rolling back with the other sd card? Surely it wouldn't ban for that.

I don't really know how it'll work, but it keeps logs when you synchronize. What I mean is, don't restore a save that has less playtime, for example, than that you had last time you synced or you will very likely get banned or at least flagged. PGL actually flags people and there are banwaves too, there were 3 in Sun/Moon for example, each going with over 6000 bans!

I thought it was that thing you are supposed to sighn up for and log into for ranked battles on battle spot.I haven't used it since oras though so I forget how it works.

You should be fine. I don't think anybody had actually had their console banned for modifying saves. Anyone who says they have is either mistaken and was likely banned for something else, or they're probably lying.
