Hacking R4s and bans

A friend used his r4 flashcart with my 3ds xl in the past (i dont really like piracy), something I know does not get you banned currently. However, could this change in the future. Could nintendo ban my device for this. Seeing as to how they could potentially release ds virtual console games in the future, it might be at their interest. Thanks!
 
Nah man, i've been using my r4 for many many years (gotta have my pokemon and chrono trigger fix) and haven't been banned. As far as i know they've used that same image (the one that appears on the 3ds home screen) for years. I'm sure that i and many other users would've reported on it. You're all good though.

Besides the 3ds is technically dead at this moment so all clear.

No. The 3DS is effectively dead at this point. It is almost completely unlikely that Nintendo will release anything else for the Virtual Console.

Check your activity log and all you will see there is a completely legitimate DS game. If Nintendo started banning the R4, they would also ban users of that completely legitimate DS game, and Nintendo cannot afford to create trust issues like that.

(This is assuming your friend just used his R4 as a DS flashcart and didn't use it for a full install of CFW – but even in that case any kind of ban is very unlikely at this point. You can double-check by looking in the root of your SD card and seeing if there is anything there you don't recognize – but don't start deleting things.)

But when hosting download play, couldn't the activity log go crazy and display the game actually being hosted? Causing the use of a flashcart to be noticeable. I'm probably completely wrong though. Thanks!
 
Thanks for all your answers! One more quick question: There isn't any risk if the 3ds remained connected online while using the flashcart right?. I remember the yellow light kept blinking when it was in use. Sorry and thanks again!

You mean the wifi light? If I'm not mistaken, that blinks regardless of whether there's an active Internet connection.

In any case, your 3DS definitely did not phone home to Nintendo and say anything about an R4. That would be ridiculous.

NOpe nope unless you got your nds settings also connected to your wifi no.

I don't know if it was. I've factory reseted the system since then. Is it safe then? Again, sorry to bother, I'm just kinda paranoid

The chance getting banned on the 3ds are very very low. Doesn't matter what you do with it. As already said, the 3DS is dead at this point. And how should Nintendo recognize that an R4 card was used? Not at all.

I thought the public headers bans also applied to ds games. ps, i know the wfc servers are down, but didn't know if they could still detect them. Im probably far off from the truth though.

I'm telling you don't worry about anything nds related, if it's been factory reset and having fooled around the nds settings then you're all clear~
