Lol, I'm really not trying to defend anything other than the fact that $5 for a year is not a lot for ANYTHING (Game Freak aside), but whatever helps you sleep at night.

Well, Pokemon that are obviously hacked (Shiny Victini with Frenzy Plant and Wonder Guard, for example) won't transfer.
Pokemon that are better made will probably pass; even an illegal move will probably get through.
There will probably be some false negatives, though; in Gen 4, a bunch of people got upset because their legitimate Shiny Jirachis were being rejected by the GTS hack checks.

I'll actually start worrying about it, when that happens. For now, they announced no DLC. The reason why they don't store it on SD cards is to prevent tampering the pokemon files. Which could easily be done with pokesav or pokegen.people who get the game after January\February can't get the free trial anymore, what happens when nintendo decides they will shut down the service or just support it for new games? its like ea games policy, you buy a game, one year later they will shut down the servers and don't provide any support for that game...
i hope they make an app which can do the same thing like the pokebank
this pokemon bank thing is just an excuse to get money, even if its 5$ a year, don't forget you now have a SD card on your 3DS which you require to play the game, you could save pokemons to the card and you owned your own limitless pokebank... before the dsi\3ds you only could save data in the game cart itself, so now you have a sd card, some games use it for save files.
it's getting close to nintendo start selling pokemon dlc packs later, something like this: "shiny new dlc, get 5 new pokemons you wouldn't find in the game before for 5 euros, this pokemons have overpowered abilities so you will kick ass on wifi battles with your friends\online people"

That's exactly what it does. The fact that it's included with pkm bank is because it will allow to make gen 5 compatible with gen 6 AND future generations, without the need of rewriting a tedious app each main games it comes.
I think the problem is that, you would rather it to become free instead of costing a measily 5$ per year.
