I'm not a Vita person, so excuse me if I'm horribly wrong, but... IIRC henkeku was userland, or at least not full access. We're able to decrypt games now, too, leading to piracy. If we can decrypt Vita ROMs with the tightest security ever and run them through userland henkaku, then why hasn't warez on 3DS userland been a thing?
