Hacking Nintendo's evil plan

I think this is stupid, but i think nintendo has an evil plan against us, first, they made that we need 3.0.1 to play Super Mario Odyssey
But what if now Nintendo makes that we need 5.0.0 to play Super Smash Bros, Metroid 4, Bayonetta 3 and Pokemon?
What is better, homebrew or that games?
