Oh please, don't give us that old argument. It's a well known fact that piracy does NOT impact sales as much as people make it seem. Sure it's morally wrong and the company wont make as much money but they still make more than enough money to get a damn good profit. Piracy isn't taking away anyone's jobs

I never said it's not a crime, it is a crime and it's illegal, i recognize that. However, no matter what reason you have for doing it, it's not going to affect the company as much as people make it sound. For every person pirating a game, 10 people(and this is a gross estimate) legally buy the game so they make more than enough profit. This, of course, does NOT excuse pirating whatsoever. And no, doing it out of revenge or what have you is just dumb

I feel as if this is happening due to change in management, the new President is young, so it will take awhile for him to learn that no matter what he does, he can't stop hackers from hacking Nintendo devices, it will always happen.

Now the big thing that will catch up to Nintendo will be 2 things, they illegally bypassed USB C protocol and the fact that if they do a full ban on switch systems, which make it impossible for you to do firmware updates and game updates, in Japan, I'm sure there draconian ways can get away but in other countries, no not really and thanks to new blood, I'm sure Nintendo will learn in the future that they will have to start doing things legally.

I believe it's illegal for Nintendo to ban you from firmware updates and game updates, online, they have a right cause cheaters can get annoying but the firmware update ban and game updates ban is technically illegal and will get them big time.

Were they in any way obliged to use USB-C (either by some mandate somewhere or they themselves claiming it supported it)? I am not aware of anything here and anything similar I have seen (Europe does some things but that is mostly "e-waste" related) would not seem to apply here.
Similarly as far as I am aware firmware updates come on games (thus no game is "blocked") and game updates might be tricky (and might be a reason to be able to return a game) but I am not sure of any law anywhere that says they must be made available and can't be treated as a privilege. I would like them to be made available as simple "copy this to the SD (and boot up)" type things but that is all that would take in the event some court somewhere did go so far.

I never said it wasn't wrong. I just don't have good morals. Nobody is going to lose their job over me stealing a few games and if they do, the game likely wasn't very good in the first place for that to happen. I'm not trying to use them not caring as a justification though I admit it sounds like it. Just why should I really care when the person on the other end would likely screw me over too. Music artists don't lose their jobs despite so much music being pirated, I would say it's far less a problem for video games. At the end of the day I'd rather save my own money than be a good person. I do think a lot of justification for stealing is stupid, you either do it and accept it for what it is or just don't do it at all rather than trying to say "I just made a copy" but yeah I would rather buy something I can't steal with my money which is probably the most condescending thing I'll say this year.

You seem to think that it will happen overnight, it takes years but eventually what Nintendo is doing will be seen as illegal and yes under law it is illegal and it will catch up to them.

Similarly if I make a luxury device then I can boot it from my network for any reason I so desire, especially cheating. I much prefer open devices where users can set up and police their own servers if they want but this then seems like one of those "vote with your wallet" type situations.

No. Nintendo knew about the vulnerability. In fact, there are comments in the current code which reference the patches to fix the issue. This was on Nintendo.

It uses something shaped like USB-C. As long as Nintendo did not claim it was USB-C (and as far as I am aware they also stated don't use third party devices). I will chastise them for poor design (they are designing for the mass market, thus they should have designed for idiots) but as far as seeming them slapped by courts or them doing anything wrong under the law, or there being scope for it to be made wrong under the law, I am at a loss for anything.

I am also not seeing scope for superbans (bans that prevent online downloading of device updates and game updates) to get them them into trouble with the court, especially not when every game carries the relevant update level needed to play it and every update level is backwards compatible.

I am all too keenly aware of laws changing, sometimes because the initial laws were written by idiots and those with vested interests and other times because of other reasons. However I am not seeing any fundamental principles of law that would make for the basis for the things you want to happen and can see plenty of things that would have to removed before it would stand a chance of happening, said things already in place I would classify as good or essential.
As such I would not support a change in the law to make such things unlawful either -- would pose far too great a restriction on other things for no real gain. If someone wants to sell a locked down proprietary piece of junk then they can try, if people are foolish enough to buy it then so it goes.

I often thought that Nintendo purposely left open a back door for their handhelds since the 3DS to marginally increase hardware sales.
I'm pretty sure the 3DS dominated the handheld market due to Hacks while the PS Vita failed massively because of their hard line approach to piracy eg. Special Vita memory cards and permanent PSN bans for any one who did manage to hack it.
I also think that the 50/60% of people who do hack only do so to play abandonware games from the 80's and 90's and turn it into a retro device.

Umm, sorry to burst your bubble but Nintendo has every right to do that. Nintendo grants you a license to use Switch OS, games and other software and they have every right to revoke it due to a violation of their EULA, which very literally means End User License Agreement . All jokes aside, Nintendo has absolutely every right to revoke your access to their software, which includes any updates to that software. The only thing you actually own is the Nintendo Switch console, everything else is only licensed to you.
