The HAVE to. Pokémon is not their (sole) property (as in, 2 other companies own claim to it as well). It's their obligation to protect third parties. This is the main reason why they give a crap about hacked consoles when the percentage of users who own the consoles, compared to the number that hack, is so relatively low...

I understand that the rom hack would be under fire due to using the "Pokemon" trademark in its name. But could the actual patch file be taken down? The patch file may not contain any copyrighted material, and could be named something completely different.

Nintendo could take down Pokemon Rising Sun and Waning Moon, amongst many others, as they use the "Pokemon" trademark also. Is this not quite damning to this rom hacking community?

It's funny to see that kind of remark x), Gamefreak is in part owned by nintendo, creatures Inc also and The Pokemon compagny also, Nintendo have the most part of the Pokemon franchise/trademark, how can you say it's not "really" their proprety ?

Bolded, since you seem to like that. And I said (sole), meaning that, no, it is NOT a first party franchise. No use arguing anyway. They can take it down, and they did take it down. End of story. If the other two hacks here bothered them enough, they could/would take them down as well.

Even though Nintendo are being scumbags about the whole situation with prism other gaming companies are much worse and Care a whole lot more about you having a hacked system and take more drastic measures
Regardless of their attempts we got our hands on the game so they lost either way

So far it seems that the more ambitious ones like Prism are going to be the only ones being taken down. Good thing we got the better ones like Ash Grey and such early.
