The HAVE to. Pokémon is not their (sole) property (as in, 2 other companies own claim to it as well). It's their obligation to protect third parties. This is the main reason why they give a crap about hacked consoles when the percentage of users who own the consoles, compared to the number that hack, is so relatively low...

Bolded, since you seem to like that. And I said (sole), meaning that, no, it is NOT a first party franchise. No use arguing anyway. They can take it down, and they did take it down. End of story.
