Hacking Nintendo Ban Wave?

I always make saves when I delete a game with JKSM, no problem with that
well... that's not the answer I was looking for, but at least you reminded me of the obvious process

about the bans in virgin consoles I heard a lot of them in Facebook, someones say it's only a joke, or for real
well, with Bantendo anything is possible
 
One of my console in 10.3.0-X without CFW and all legit titles was banned, but it"s psossible an isolated case and very weird:

Maybe isn't a ban, maybe is only that you didn't updated the console and that message only shows to you because you didn't updated?

I you want to try, update the console and look again if you're banned or not.

Updating the console is not going to lift this ban, people from all kinds of firmwares have been getting banned, even on the recent firmware 11.4, whether you have homebrew, cfw or both.
 
In response to this thread and to answer what mentioned the other day, freeshop had no effect. I am not banned
 
I sold my old 3DS month ago in a website like ebay here Brazil ( MercadoLivre ). Today i got strike from Nintendo of America sayin its has ilegal software. But its was not even active anymore. So Nintendo started this "strike" back day when i was selling and only now website toke action.

So weird. Nintendo are taking seriously

Its a website like ebay dude. But less restriction. You put your sell online but even after its got finish its still registered in system in case i wanna put online again.

I cant explain it better. But i think Nintendo sent a complain to the web site and then toke long time to website analyze the complain and take action by strike me.

Nintendo do that type of things in Brazil MercadoLivre a lot since a lot of time ago.
 
Maybe in the future it could be possible to mask CFW to make it appear legitimate kind of like Magisk hides root on Android. Or at least make the homebrew apps appear as legit apps such as settings or Activity Log.

I'm pretty sure the CFW is not being directly detected, based on the available evidence. I'm pretty sure what's being detected are illegitimate titles, such as FBI, freeShop, etc. If we disguise these programs as legitimate shovelware games, or just turn off the Spotpass and Friend List settings that allow for their detection in the first place, it shouldn't be too difficult to avoid a ban in theory.

Myself included. The issue is that people also have the "share information" Spotpass setting enabled by default, which appears to be correlated with bans.

Sadly there's no common denominator, doesn't explain the legit ones banned either...

The only possible answer would be that they just decided to roll out the bans for plenty of past detections they had gathered for various reasons

Maybe the best way to understand some of those violations would be to check and poll the legit ones banned

First, I believe there are numerous factors at play. I hypothesized on Day 1 that this banwave was the culmination of a months-long undertaking by Nintendo to ban as many confirmed CFW users as possible.

Second, if you look at the polling data, there are relatively very few people who are banned and also had the "sharing information" setting turned off. Many of these people went back and realized they had it turned on. There also hasn't been a single confirmed case of an OFW console being banned that hadn't done something like use the Homebrew Launcher or system transfer with a CFW system.

While it is a safeguard for sure, I don't deny that, it's certainly not a rule of thumb (as in, that this step will save your console from a ban wave)

I don't have proof to share at hand, but I already got a friend with a "pristine" console banned, the only thing in common with the hacked ones he has is that they connect to the internet on the same household, no use of HBL ever, or system transfer or NNID, nothing (it was meant for collection only)

Funnily enough, his hacked ones didn't got a ban yet...

Strangely, I also found some cases like that on some groups I visit on Facebook, could it maybe be a mishap?, something to do with being online and the friend activity of other consoles? (OFW was not sharing info either)

I have PS3 CFW and I never got online because I don't care about online. Its wise things to do. DONT GO ONLINE!

Coming back to the other thing, as long as there's people with that turned off and still being banned, then it doesn't mean it saves consoles, just that if you're detected you might be on a delayed list like many people on this waves...

Talking about waves, have they stopped for the time being?

Again, there are other variables at play, but generally speaking, turning off the "send information" Spotpass setting gives one an 86.2% chance of not being banned, according to the poll. This poll doesn't take into account other variables, such as the Friend List setting. It's possible many of the 13.8% of people who had the "send information" setting off but still got banned also had the Friend List "show what I'm playing" setting on. We also know that a lot of people in that 13.8% were mistaken and actually did have the setting turned on.
