Nintendo 3DS Devkit Question

So with the help of someone else, I got retail firmware running on a devkit 3DS. Nintendo Zone works and communicates with my Hotspot, but here's the question I'd like to ask to anyone who'd know more than I would.

What is stopping a devkit from using Download Play or StreetPass functionality?

Don't ask me why I'm doing this, I just need to know what part of the system precisely is stopping that bit of functionality.
