Exactly my thoughts - although I'm sure Nintendo has a way to detect it but again cat and mouse.

The cart encryption has been cracked (Lotus3 was decapped in 2021), leaving it wide open now to piracy via flash cart.

Hence why I now have a mig flash and will be buying two switch 2 's

I'm sure nintendo will pull a 3ds and make switch 1 flash carts only work with switch 1 ggames
