It upsets me that we could potentially execute people who may have been helping a murderer and didn't know they were actually doing anything wrong. :(

Corporations have more rights than a man today.

Most laws have phrases like "knowing and/or willingly" to protect a person from stuff like that. Like if a friend ask you for a ride to his girlfriends house and you take him and once he gets there he goes in and kills everyone in the house, as long as he did not tell you what his intent was then you are safe, but if he told you he was gonna commit murder and you helped any way then you would be in some serious trouble.

I have read the documents , and the gist of it is this ....... hey people , so your looking for info on how to mod your wii , ps3 , xbox ect. , well this is where you can find that info ( name any site here ) (while I tell you were you can find it ) I'm gonna allow one of my friends to tell you about other things ( name an advertisement here ) and my friend is gonna pay me to allow him to talk to you ....... what law did I break here ?

Modding game systems isn't illegal.

Now, if you posted links to pirated games here... mods would remove your post(s) and likely ban you (depending on if you did it repeatedly), since that's illegal in the US/UK.

I've been reading through these posts about certain legality on these issue, but what you said stood out. If modding a console isn't considered illegal, why are so many companies (like Nintendo or Sony) against it? To be honest, I can't see why so many people think that altering a game system to play games that are never released in the US (legally bought) as being piracy or illegal. Josytiq is one of those places where people think it's immoral. I'm just curious is all.

They WANT it to be illegal, but it's not so they often have to wait until there's obvious piracy involved before they can take action (and then it's often just against the piracy aspects of it since that's where they have the foothold).

The reasons they don't want their systems modded isn't just about piracy though, and it's not like we can fully blame them. Having a system that only you (and people you can control) can program for in theory makes for a safer environment, and nowadays when game consoles handle credit card transactions and such that's more important (in addition to them holding personal information). It also allows them to try to enforce a specific business model, but that's a whole 'nother discussion.

Propaganda, but again that's a big discussion on it's own (and not one I'd want to get into until I have time to look up relevant examples).

As stated, if it's proven that they didn't do it with the intent to harm, they're often just let go (or given a less harsh sentence).

The law kinda of looks at it this way. You can mod your console and backup your games, but you can not run a service modding consoles or make backups of your games and share them with the world. The reason that you can not mod someone elses console is because of the fact that you can not be 100% sure of what that other person will do with that console. Running a modding service is not as bad as piracy and some times if you protect your self legally then you can make it harder for them to make the charges stick. Well something like this happened with this guy. He supposedly but a backup in the xbox to prove it worked, but the "evidence" was screwy so it did not help the government.
