only a game like warioware would have you turning the thing completely upside down anyway, I cant imagine the need in any other game to tilt beyond 60 degrees left or right. So if turning the thing upside down does lose the effect (which again, I don't believe is the case), then really only one game will suffer because of it, oh well. A warioware game is something I have little interest in for the handheld anyway.
And while its not quite the same, have you gone to a 3d film? They too have sweet spots, if you're too close to the screen or two far to the left or right, the 3d effect is weakened to lost. However if you look at it in the middle of the theater, it doesn't matter if you tilt your head or not, it stays in 3D
