It doesn't. It seems that there are only marks (heart,star,...) date and picture number in there. Because if you add some new JPEGs into the folder, there is no error-message but also no new pic. If you replace old pics, there is also no error, but there is only the "error picture". I think, this will also happen, if you delete the pic.dat and add some pics with the same format "HNI_xxxx.JPG" just with xxxx as the counter.
So - pic.dat isn't really a problem. I think the main problem is in the JPG's themself.

The DSi manual said:
Photos taken on a Nintendo DSi contain thumbnail data and photo data.
Editing the photos on a computer or other devise does not guarantee that the thumbnail data will reflect those changes.
When nintendo says it them self, you got to believe it's true.

Nintendo also say that flashcarts are "illegal devices" and that playing games on them may render them unplayable.

WROOOOOONG!
 
The real problem is that each JPG created by the DSi has a checksum from 0x18a to 0x1a6. If someone could figure out how this checksum is created, it would be possible to create custom JPGs that the DSi will display.
