I see 3 possibilities :
1- You closed the 3ds and there was something in between the two screens. The pressure may have damaged the upper screen.
2 - Dead pixels.
3 - It could also be water.
You could get a new screen or keep it that way if it doesn't bother you to play, check the other screen to see if it's responding correctly.
