Tbh i wouldn't bother using flashcart on 3DS..it's not worth it, with all the perks that will be available when they do the big update in May, it would be wasteful of online gameplay to have Wifi disabled.
Do you have your old DSi/DSL/DS? i;d use that instead for now and see what the future holds.

No... you RENTED SONY's CONSOLE. You have an agreement that you oblige to that's activated as soon as you buy the console, which SONY is using to get at geohot. And, every PS3 user has to agree to it. EVERY. SINGLE. ONE.

It is their console, by law. If they want to get every console back, you have to oblige by law.
Sorry... that is not true.
That is what the companies would like you to think, but it's just not true. You purchase the device, there is no rental or leasing agreement.

As an addendum, IF that were true, Sony and Microsoft wouldn't be wasting their time banning PS3/XBox consoles from PSN/Live, they'd be taking their consoles back for 'improper use'.

Show me where they said you rent the console. Even then they can't sell the product and then say it was a rent later.

Yes they can ban you from their online services.
You'll be free to continue to play by yourself though.

Could you get banned from online services for using a flashcard? Possibly. You can refuse somebody access to a network you own for any reason, because it's considered private property. For instance, nobody has to let you use GBATemp, they could block you for any reason they wanted to. (Not implying anything against the mods, just saying)

Realistically? At least with current DS mode flashcarts, it shows up as whatever game it spoofs. So as long as you update your card before you use it on updated firmware, there's no way for them to know you used a flashcart. I'm sure somebody still actually plays fish tycoon out there for real.

You bought the hardware.

You're renting the software

(technically a lease)
They have no right to remotely brick your machine for running a flash cart, just like Windows (which is also a licensed OS running on purchased hardware) has no right to brick your PC because you installed Daemon tools (which contains emulation methods that bypass DRM). I'd use DVD Decrypter (directly breaks CSS) as another example, but that was added as an exemption to the DMCA, I'm not exactly sure where daemon tools stands, got any info on it?

Anyways Nintendo hasn't banned anybody from online for simply using a flash cart, and I've not heard of any plans to do it, but you should assume it can happen in the future because it's a possibility.

Nintendo can't tell you're using a flashcart.
Thus, no ban ever.

The end.

That's the thing... we don't know for a fact yet that nintendo can't. We know that the current firmware bypasses Nintendo's initial detections, but we don't know what information nintendo records every time we start up a game. There is a chance there is something being recorded data wise that would let nintendo know in the future with a system menu update. It's something we won't know till there is a system update or until we have the system hacked and we can see what the system is doing.

Right now, everyone's on the same page... We don't know what the 3ds is doing in the back of its head, we can only know what the system let's us know.
