Hacking Flashing - would I loose my pics?

I have some pics on my 3DS of my cat who passed away.

If I flashed my 3ds with CFW:

1) Would I loose the pics on a successful flash?
2) Would I loose the pics on a unsuccessful flash and it got bricked?

You won't lose anything if you successfully install CFW but if the pictures are important you should copy them to a computer
