One by one, nations are falling to the power of Nintendo. I hope this epidemic doesn't hit the US.

Are they really falling to the "Power" of Nintendo or is it reality is just setting in. True.... flash cards can do homebrew, music, & video. But in reality the majority of cards are used for roms. I'm just as guilty. But I do also buy games, probably more than most. If they really wanted to market a card for homebrew only it would be very simple to design the card to NOT PLAY ROMS.

Also why doesn't Nintendo make a cart themselves in this situation. Actually making a cart isn't even necessary, since homebrew could be made available via the eShop or another type of platform. If Homebrew was available without using a flashcart of any sort (be it with or without ROM support), basically all carts could be banned since there is a legal alternative. But as said this has been a grey area in most places, but is becoming more and more a black and white area. Illegal vs Legal. What I'd like to see is that is it possible to actually ban every sort of tech related to another companies hardware if it isn't officially licensed. If it is (partly what this news is about), what will happen to a lot of innovative use of hardware and software. For example (no hardware added though) looking at what Microsoft did with Kinect and what others without any affiliation did with it.

nintendo won't make a profit off homebrew, but nintendo could make a profit off a legal 1st part flash kit. the thing is, they will never make one because it would most probably bring publicity about illegal kits which can run roms.

also, its not like the big companies want to embrace homebrew. its only been recently that small studios (essentially homebrew coders) have been able to get on xbl and psn.

Congrats to whoever came up with that idea. France already has it rough with friggin Hadopi (Thank god we are still on even ground with the government here in Canada thx to Openmedia.ca) they dont need this on top of it....

Well if the sony attack teached anything to someone about attacking ppls liberty (The process against Geoth made angry hacker destroy the ppls trust into Sony and their online service) it sure doesnt show that everyone understood this fact.....

Oh well watch how they hack the sh=t off the 3DS, the nintendo shop or something else as retaliation.

This is why Flashcarts should just die and CFW should be used on the 3DS. CFW has so much potential on the 3DS.Flashcarts have more limitations.

This is completely dumb. Like the picture shows, some people only use it for homebrew. My friend has an R4 and uses it strictly for homebrew, he will NOT download roms.

1- People pirate games and the gaming industry is still the biggest in the world.
2- That are people that use these devices exclusively to run homebrew.
3- Nintendo (or any other company) refuse to leave even a little window opened. The sell you the hardware, but they also want to lock you with their software, so they can charge a premium for basic extra features (video recording, for instance, could be a downloadable app in eShop for the 3DS).

So, let's learn from this case. Make an OS that can run unsigned code. Limit the possibilities, even encrypt official software with a secret private key, and leave a sandbox for homebrew. Problem solved. Everybody is happy. Anyone who buys a flashcart is DEFINITELY a pirate, and we won't whine when you sue him.

I agree that flash kits help hardware sales. If it weren't for DS flash kits I'd have just used a DS emulator to play a game or two, but since I got a DSi with a flash cart it's preferable for me to get actual games since I can play them portably (and despite what some people say, not all DSiware is shit). The issue with varying game companies is that not all of them make a killing on their hardware... see: Sony selling the PS3 at a loss for a long time.


they dont give a damn about hardware sales. even though nintendo made slight profits from hardware, the money is in software sales.

so by buying a ds, they make a profit of like 10$ but loose hundreds in software sales.

and as legit it is to say, there is homebrew, get real, people that ONLY use this stuff for legal homebrew (meaning no emulation which isnt legal) just dont make up a high percentage.
im pretty sure, appart from infringing the ds card design, if there were homebrew only flashcards, nintendo wouldnt care.
but there is no homebrew only flash card, is there? wonder why

iPlayer, Datel Game's and Music, Max Media Dock ones off the top my head.

Indeed. This is like banning all writable CDs and DVDs because you can burn pirated movies and games on them. Ridiculous I tell you

Sucks for France. It would be a shame if that also happened here in the U.S. but we shall see. I'm still waiting for a good one to release for the 3DS. Incidentally, if you're going to region-lock everything, then pull a Capcom and release games ONLY in Japan so that people have to not only import a game but buy a whole new system to play it as well, then I will shamelessly download the ROM for that game. Nintendo, among others, is doing just fine on sales last time I checked, so if they're going to try to screw people, then they can't expect everyone to put up with it.

Don't get me wrong, I still buy a good portion of my games, but I'm not going to stop downloading ROMS on account of "copyright infringement". I've already bought several games that were a huge letdown, so I like to, if nothing else, test a game to see if I even want it.

Then there's the case of homebrew, which goes without saying.

The outcome of all this, however, will likely end up just like how the music industry is in their similar crackdowns: the tighter you squeeze, the more people(hackers, etc.) will slip through your grasp.

but you know eventhough they will do that someone WILL still gonna buy/import it,. esp if its for 3DS. cant wait for the homebrew scene to fully bloom - well i want those homebrew apps :) / region free
