There's a difference between bad PR and slander, and unless you have evidence to prove your case, it's slander. Gateway already has a bad rep for including bricking code in their firmware, but that doesn't mean that whenever a negative rumour pops up we're going to treat it as true by proxy. A big part of journalism is not taking sides, and as such, we're not taking sides here. If the Gateway does turn out to be withdrawn from the market and if reliable insider sources confirm that Evo3DS is made by the same team, our users will be the first ones to know. Until then, rumours are going to be treated as rumours - no self-respecting website will ever publish wild fantasies as fact.

I wouldn't use the term "frivolous" in regards to slander or libel, seeing that they're both acts of defamation by spreading false statements and in both cases demanding an apology, a correction or compensation of some kind is not something unwarranted, but that's besides the point - you are correct, libel is written, slander is spoken, my bad. Your freedoms end where somebody else's begin - when posting news you can't go around spreading completely false information and defend it by using the freedom of speech argument, it's dishonest journalism and it works against you, lowering your credibility.It's actually libel, but both are only excuses to file frivolous lawsuits and demean freedom of speech.
sorry for adding to the off topic chat, but just wanted to add an theory to this here, the whole delays could of been because they hit a brick wall with actually applying the FPGA update via the 3ds, the card in their video could of just been a externally updated card.
i don't think their initial plan would of been to just drop the card and release a new one under a new name, but if it is possible that they found out that their planned method of updating didn't actually work it could be feasible that it was a last resort to just drop it and start programming their new chips under a new name with their already complete 2.0 update, after all their mud slinging about "hahaha we are update-able just you wait clones" it would of been a bit embarrassing to say.....ooops it didn't work out like we planned all the early adopters are screwed sorry but here is gateway 2.0 buy now!!!! they would loose any future trust from the community, so its easier to pretend your a different team and have the slate wiped clean, especially after the bricking fiasco

This makes the most sense to me. Current gateway card wasn't compatible with how they did NAND saving and multirom so they had to make a new one.

Kinda stupid to say "Oh this card is updateable" and realize "Crap, its not that updateable"

Normal users can do whatever they want, it's just the portal itself that refrains from treating rumours as fact unless there's strong evidence that suggests something's cooking. What you guys believe in is entirely up to you, what I'm saying is that this isn't getting coverage because it's speculation and it's not treated as fact because it's a rumour, since those subjects popped up earlier.
