Hacking does nintendo still ban for CFW at random?

haven't heard anything since last ban (i think it was 2 years ago?)
for a person who install games using FBI and playing online, i think there is a risk, but i didn't hear any ban since freeshop is closed.

No and there never has been a ban actually proven to be directly linked to use of cfw/homebrews

The only known bans caused by the use of online multiplayer are due to: excessively shared headers (for physical games and their roms), cheating online, or playing (a very limited number of high-profile games) before launch

only bans was leaked pokemon before release playing online and the sending data to nintendo here is a guide on what to disable
